Alleged deputy shooter enters not guilty plea

Michael D’Alessio, the Philmont man who allegedly shot a deputy last year, pleaded “not guilty” to reduced charges in Columbia County Court in Hudson Tuesday.

D’Alessio, 45, was originally charged with attempted aggravated murder, an A1 felony, first-degree attempted manslaughter and first-degree criminal use of a firearm after a stand-off with authorities Sept. 8, 2008.

When three Columbia County Deputies  came to D’Alessio’s Philmont residence to arrest him on an assault charge he allegedly shot at them and barricaded himself into his house.

Authorities said that he later shot through an air conditioning unit hitting Deputy Louis Bray in the arm after a projectile bounced of the officer’s bullet proof vest.


In court Tuesday the charges he was facing had been reduced to two counts of first-degree reckless endangerment, Class D felonies.

According to D’Alessio’s attorney Mark Portin, speaking in court, the grand jury had voted for the lesser charges.

“Mr. D’Alessio’s in a much different position today,” he said.

Portin asked for bail for his client, who has been sitting in the Columbia County Jail without bail for more than a year.

First Assistant District Attorney Michael Cozzolino asked that bail not be given in the case, saying that a 12-gauge shotgun was discharged inside a house and a deputy hit.

“The deputies were there executing an assault warrant,” he said. “He did not surrender himself and discharged a firearm.”


Portin countered that D’Alessio wasn’t facing any assault charges in regard to the case.

Judge Jonathan Nichols, who is overseeing the case, said that if the situation had been slightly different on the night of the incident, D’Alessio might be facing a greatly altered situation, but agreed to bail in the case—$25,000 cash or $50,000 bail bond.

The trial is set to begin Feb. 22, 2010.

Portin seemed confident with his case.

“The evidence may not be sufficient to convict on these two charges,” he said in court.
